Did your clients pay penalties and interest during the Covid Years?

The recent tax court case, Kwong vs. US has warranted professional review of transcripts between 2019-2023.

Recent court decisions involving IRS penalty procedures are prompting many tax professionals to revisit certain penalty assessments from 2019–2023 to determine whether it is appropriate to file for a refund or credit for their client.

Why Tax Professionals Are Paying Attention

Recent procedural rulings involving IRS penalty assessments have created renewed discussion around:

  • Supervisory approval requirements
  • Assessment procedures
  • Timing and documentation standards
  • Certain penalty assessment protocols

For some taxpayers who paid substantial IRS penalties between 2019 and 2023, these developments may justify additional professional review.

Not every case will warrant further analysis. However, many practitioners believe these developments deserve careful attention when evaluating prior IRS penalty matters.
